TRANSFER POLICY
Please read this policy in full before purchasing a firearm online and selecting Gunslinger's Guns as your FFL dealer. By selecting and/or shipping a firearm to Gunslinger's Guns for a transfer, you agree to the terms below.
Effective Date: This policy is current as of the date of your transfer. Gunslinger's Guns reserves the right to update this policy at any time.
POLICY CONTENTS
I. GENERAL POLICY
- A.Gunslinger's Guns is a home-based Federal Firearms Licensee (FFL) located in Frederick, Maryland. All transfers are conducted by appointment only.
- B.By selecting Gunslinger's Guns as your FFL dealer and shipping destination, you agree to the terms and conditions outlined in this Transfer Policy.
- C.Gunslinger's Guns reserves the right to refuse any transfer at its sole discretion.
- D.Gunslinger's Guns does not offer or process Maryland secondary sales (private-party handgun transfers between two individuals). It is recommended that these transactions be conducted at a Maryland State Police barrack.
II. ELIGIBILITY & MARYLAND COMPLIANCE
- A.Firearms will only be transferred in accordance with applicable federal law, ATF regulations, and Maryland law. Proposed Transferees must complete an ATF Form 4473 for all applicable firearm transfers and a Maryland 77R application for all Maryland-regulated firearms, as applicable.
- B.Gunslinger's Guns will only release a firearm to a Transferee following a NICS "Proceed" or Maryland State Police "Not Disapproved" background-check result. Gunslinger's Guns DOES NOT release firearms on a NICS "Open" status and DOES NOT permit use of the Brady Date for firearm transfers. Please note that Transferees between the ages of 18 and 21 purchasing long guns may experience an extended background-check period, potentially lasting several business days.
- C.Any NICS background check that remains in "Open" status upon expiration will require the proposed Transferee to obtain a UPIN before Gunslinger's Guns will attempt another background check. It is the proposed Transferee's sole responsibility to obtain the UPIN. The Storage & Forfeiture section of this policy applies to firearms associated with an "Open" background-check status regardless of whether the proposed Transferee is attempting to obtain a UPIN.
- D.Gunslinger's Guns generally accepts Maryland-legal, non-regulated firearm transfers (long guns) from other states when the shipment includes: a copy of the sender's FFL license if the sender is a dealer; or a legible copy of the seller's valid, state-issued driver's license or other government-issued photo identification if the sender is an individual; and complete Transferee contact information.
- E.Gunslinger's Guns generally accepts Maryland-legal regulated firearm transfers, including handguns, from out-of-state FFLs ONLY. A copy of the sending dealer's FFL must be included with the shipment along with complete Transferee contact information.
- F.Gunslinger's Guns reserves the sole right, for any reason, to decline or refuse to perform a transfer. Gunslinger's Guns will only transfer Maryland-legal firearms to an eligible party. It is the buyer's sole responsibility to determine whether a firearm is legal to own, possess, and transfer in Maryland before purchasing it.
- G.Maryland-compliant handguns manufactured after January 1, 1985 must generally be listed on the Maryland Handgun Roster before they may be transferred. Handguns that are not eligible for transfer under Maryland law will not be transferred.
- H.Certain long guns, including certain AR-style rifles and other firearms, may be prohibited from transfer or possession in Maryland. Buyers are responsible for verifying compliance before purchasing a firearm.
- I.All Transferees must be legally eligible to possess and receive a firearm under applicable federal and Maryland law. Firearms will not be transferred to prohibited persons.
- J.Gunslinger's Guns is not responsible for purchases made by a buyer before the buyer verifies Maryland compliance. No refunds or compensation will be provided by Gunslinger's Guns for firearms that cannot legally be transferred. Non-compliant firearms are also subject to the Storage & Forfeiture provisions of this policy.
III. MAGAZINE RESTRICTIONS
- A.Any detachable magazine capable of holding more than 10 rounds will not be transferred with a firearm except where an applicable exemption applies.
- B.If a firearm purchased online includes a magazine capable of holding more than 10 rounds, the seller may ship the firearm without the magazine.
- C.If Gunslinger's Guns receives a magazine capable of holding more than 10 rounds during a transfer and the proposed Transferee does not qualify for an applicable exemption, the firearm may still be transferred if otherwise eligible, but the magazine will be deemed abandoned to Gunslinger's Guns. No compensation will be provided for abandoned magazines.

The per-day storage fee increases over time. The storage fee accrues regardless of when a background check or transfer application was initiated or completed. See Section VII – Storage & Forfeiture for additional details.

VI. PICKUP
- A.All Transferees must appear in person at their scheduled appointment with valid government-issued photo identification. For firearms regulated by the State of Maryland, applicable Maryland residency and identification requirements must be satisfied.
- B.Handguns and other regulated firearms require a valid Maryland Handgun Qualification License (HQL) or applicable exemption, when required.
- C.Maryland regulated-firearm transfers are subject to the applicable waiting period and Maryland State Police approval process. Gunslinger's Guns will notify the proposed Transferee when the firearm is eligible for release.
- D.Transferees must complete pickup within 30 days of approval notification or before expiration of the applicable background check or transfer authorization, whichever occurs first. If a new application or background check is required because the Transferee failed to complete pickup within the required period, additional applicable transfer fees will be charged.
VII. STORAGE & FORFEITURE
- A.Storage Fee: A $2-per-day storage fee applies to each item or firearm that has not been picked up within 30 days after Gunslinger's Guns first notified the proposed Transferee of its arrival. This fee increases to $5-per-day after 60 days and to $10-per-day after 90 days. The storage fee accrues regardless of when any background check or transfer application was initiated or completed. An NFA item experiencing ATF processing delays will not have storage fees applied. An invoice for accrued storage fees is emailed to the proposed Transferee every 30 days with an online payment link. Payment is due upon receipt.
- B.Failure to Pick Up, Failure to Pay Storage Costs & Unclaimed Firearm Forfeiture: Failure to pick up an item or firearm, resolve an "Open" or "Denied" transfer, and/or pay any accrued storage costs and late fees within 120 days of the item's or firearm's initial arrival at Gunslinger's Guns, for any reason other than an NFA item experiencing ATF processing delays, will result in the item or firearm being deemed contractually abandoned and forfeited to Gunslinger's Guns.
- C.Forfeited items or firearms may be liquidated by Gunslinger's Guns to recover accrued storage charges, administrative costs, and liquidation expenses. Gunslinger's Guns will send a warning email to the proposed transferee at 90 days referencing this policy.
- D.In the event of liquidation by Gunslinger's Guns, Gunslinger's Guns will send a final USPS Certified Mail notice to the proposed Transferee at the address provided with the transfer information notifying the proposed Transferee of the forfeiture and providing a copy of this policy. No compensation, reimbursement, or refund will be provided for forfeited firearms or items.
VIII. OPEN-STATUS/DENIED TRANSFERS & RETURNS
- A.If a background check or transfer application does not result in a NICS "Proceed" or Maryland State Police "Not Disapproved" result within 30 days of application, Gunslinger's Guns may permit the firearm to be returned to the transferring FFL and/or shipped to another licensed FFL at the buyer's expense, subject to applicable legal and regulatory requirements. This option is available only if: the firearm has not been forfeited or liquidated under the Storage & Forfeiture provisions of this policy; all accumulated storage fees are paid and current; a $50 administrative return fee is paid; and the proposed Transferee provides Gunslinger's Guns with an acceptable prepaid shipping label or remits advance payment to Gunslinger's Guns for shipping, packaging, insurance, and other costs to ship.
- B.Gunslinger's Guns is not responsible for any shipping, insurance, packaging, restocking, transfer, or other costs associated with returning and/or transferring a firearm nor is it responsible for any loss or damage of the firearm in shipment.
IX. LIMITATION OF LIABILITY
- A.Gunslinger's Guns does not inspect firearms received for transfer for condition, safety, function, fitness for use, defects, authenticity, completeness, or other mechanical or cosmetic conditions. The acceptance of a firearm for transfer by Gunslinger's Guns does not constitute an inspection, warranty, representation, or certification concerning the firearm's condition or safety.
- B.Gunslinger's Guns does not provide insurance coverage for firearms or other items received or stored in connection with a transfer. It is agreed Gunslinger's Guns is not financially responsible to the proposed Transferee or any other party for loss, theft, destruction, or damage involving a firearm or other item while it is stored at Gunslinger's Guns premises or while it is in transit or being shipped to or from Gunslinger's Guns.
- C.The proposed Transferee acknowledges that the handling, possession, and/or use of firearms involves inherent risks, including the risk of serious personal injury, death, property damage, psychological trauma, and other personal or financial loss.
